We make every effort to display product colors, sizing, and details as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual product color or appearance. We reserve the right, at any time, to modify, discontinue, or limit the quantity of any product without prior notice.

All orders are subject to acceptance and availability. Your order is not accepted, and no contract of sale is formed, until MYIONIX confirms acceptance of the order (e.g., via an order confirmation email). We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or illegal activity, errors in pricing or product information, or inventory unavailability. Products purchased through the Site are for personal use only and may not be resold, redistributed, or used for any commercial purpose without our prior written consent.

All prices are listed in U.S. Dollars unless otherwise stated and are subject to change without notice. Prices displayed do not include applicable taxes, duties, or shipping charges, which will be calculated and disclosed at checkout. You represent that any payment information you provide is accurate and that you are authorized to use the designated payment method. Payments are processed securely through Shopify Payments and/or our other designated payment processors.

MYIONIX is not liable for delays caused by the carrier, customs processing, weather, or other events outside our reasonable control.

EXCEPT AS EXPRESSLY STATED BY MYIONIX, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RESULTS FROM USING OUR PRODUCTS MAY VARY FROM PERSON TO PERSON.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MYIONIX AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain consumer-protection laws in your country or state of residence.

11. INDEMNIFICATION

You agree to indemnify and hold harmless MYIONIX and its owners, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the federal and state courts located in New Mexico, USA, unless prohibited by applicable law.

13. INTERNATIONAL CUSTOMERS

MYIONIX ships to customers worldwide, including the United States and other countries. Customers outside the United States are responsible for any customs duties, import taxes, or fees imposed by their country, and for complying with local import regulations. Consumers in the European Union, United Kingdom, or other jurisdictions with mandatory statutory rights retain those rights notwithstanding anything in these Terms.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes are effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
